Though the petitioners are absent, husband of respondent No.2 namely Vinod and respondent No.2 are present before this court and they are duly identified by their advocates. 2.

During the course of hearing this court had suggested on the last date that whether there is any possibility to settle the matter out of the court. Wherein respective parties had given their offers. Wife-respondent had put her offer of Rs.6 lakhs towards one time settlement whereas husband had given his offer of Rs.5 lakhs.

Today, in the morning session, this court again tried to explore the possibility of settlement by suggesting both the learned advocates to arrive at certain figure, looking to the narrow difference in the offers put by the parties. Both the advocates by using their skills have made the parties to settle the matter and thus the matter is taken in the afternoon session. 4.

The parties have now arrived at a figure of Rs.5.50 lakhs and they are now willing to file proceeding for divorce by mutual consent where terms and conditions in details would be presented before the Family Court alongwith terms as regards visiting rights of the children etc. In this view of the matter, respondent No. 2 has also accepted that she will withdraw all the proceedings once the settlement is reduced into writing. 5.

In view of this the criminal application can be disposed off. Hence, the following order:

ORDER

a] The criminal application stands disposed off in above terms.

b] Parties have agreed to file petition for divorce by mutual consent within a period of four weeks from today.
