THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Wakade Ramesh I. Mr. SK Tambe, AGP for Respondents: 1 to 3.

__________ CORAM :

S.S.SHINDE & P.R.BORA,JJ.

DATE : 5 th February, 2016.

PER COURT :

1) Heard. This petition takes exception to the transfer order dated 25th August, 2011 issued by Respondent No.4/Secretary as also the petitioner seeks directions to Respondent Nos. 4 to 6 to grant unpaid salary to him for the period 1st September, 2011 to 11th June, 2012, excluding 35 days' slary and particularly as per order dated 9.4.2012.

2) Admittedly, the petitioner, being aggrieved by the order of termination filed an appeal. According to learned Counsel for the petitioner, the petitioner has succeeded in the appeal. The said developments took place in the year 2014-2015. in

that view of the matter, we are not inclined to consider the prayer clause (B) of the petition. So far as prayer clause (D) of the petition is concerned, it appears that the Education officer (Secondary), Zilla Parishad, Aurangabad, has already written letter dated 9.4.2012 to the Head Master - Respondent No.6. In our opinion, since the Education officer has written letter to the Head Master and in case the concerned Head Master is not following the directions of of the Education officer, the Education Officer can take appropriate steps against the Respondent No.6-Head Master in accordance with law. We have not expressed any opinion about the steps to be taken by the Respondent No.3-Education officer. For the reasons, as aforesaid, the petition stands rejected.
