The learned counsel for the applicant has tendered across the bar the order passed by this Court in connected matters in Civil Application No.14985 of 2017 in First Appeal (Stamp) No.14233 of 2016 and has prayed for passing similar order. The counsel appearing for the acquiring body does not any objection for passing such order. In view of the submissions made, the following order is passed:

ORDER

i) The applicant is permitted to withdraw 50% of the deposited amount on furnishing an undertaking to the satisfaction of the Registrar of this Court. ii) The applicant is also permitted to withdraw

947-CA-915-2019.odt (2) 25% more of the amount deposited in this Court on furnishing solvent surety/security in the like amount.

iii) Balance amount be invested in Fixed Deposit Receipt in any nationalized bank for the period till disposal of the appeal.

iv) The civil application stands disposed of.
