The petitioner / Institute which claims to have a minority status is before us aggrieved by the fact that though all these years it was permitted to run B.Ed. College and was even permitted to undergo the common admission process, in the current year at the 11th hour, after the admission process has started its right to admit the students has been put on hold by the impugned communication on the ground that minority certificate / letter containing minority type has not been submitted by it.

Learned AGP on written instructions from the Joint Director of Higher Education Maharashtra State dated 21 September 2023, submits that the petitioner / College would be allowed to admit the students in the current admission process in the CAP Round - 3 pursuant to the communication received by his Office from the

Department of Minority, State Government of Maharashtra dated 18 September 2023.

Learned Advocate for the petitioner also places on record a copy of the very same communication dated 18 September 2023, wherein, it has been, inter alia, informed that the petitioner's College would be permitted to go through the current admission process subject to the condition that it would obtain necessary minority certificates in accordance with the governments policy. 4.

In the light of the above, nothing survives. The petitioner's grievance stands redressed. The petition is disposed of having served its purpose.
