Heard learned counsel for the applicant.

Perused the application. The applicant has preferred appeal against impugned judgment and award passed by the learned Commissioner under Workmen's Compensation Act. There were office objections, but the same were not removed within stipulated period. Therefore, learned Registrar of this Court constrained to refuse the registration of the appeal. The authorities of the applicant - Zilla Parishad Jalgaon was not aware about order of dismissal of the appeal passed by this Court. The letters of the Government produced on record reflect pendency of proceeding before this court. In view of circumstances, applicant could not take steps within stipulated period for restoration of the present appeal at its original stage. Learned counsel for the
2 922-CA-14517-16 applicant explained attending circumstances in detail and prayed for restoration of the appeal in the interest of justice. 3.
In view of nature of subject-matter and submissions advanced on behalf of the applicant as well reasons mentioned the application, there is no impediment to allow the application for condonation of inordinate delay caused in filing the present application. Therefore, application stands allowed in terms of prayer clauses "B and C". The delay caused in filing the application is hereby condoned. The order of refusing registration of the appeal passed by the learned Registrar is hereby quashed and set aside. The proceedings of the appeal be restored to its original stage subject to condition that applicant-appellant shall remove the office objections within eight weeks from its restoration.
