IN THE HIGH COURT OF JUDICATURE AT BOMBAY

VERSUS
DINESH ASHOK GAIKWAD ...
Advocate for Applicant : Mr. Nanabhau R. Thorat ...
CORAM : ARUN R. PEDNEKER, J.
DATE : 08th FEBRUARY, 2024 PER COURT:
1.
Heard.
2.
The learned counsel for the applicant submits that the applicant seeks transfer of the divorce petition filed before the Civil Judge, Senior Division, Pune to Civil Judge, Senior Division, Majalgaon. Although, in the prayer clause it is mentioned that the petition may be transferred to Dharur. I am informed that there is no Senior Division court at Dharur, as such, the applicant submits that the petition be transferred to Majalgaon.
3.
The learned counsel for the applicant submits that the applicant and respondent got married in December - 2012 and have 2 children and the children are with the applicant. The applicant is a housewife and she has no source of income and the applicant is staying at
2 956 Mohkhed along with her parents. The learned counsel submits that the respondent - husband is in service and is in a position to defend the proceedings at Majalgaon. However, it would be inconvenient and difficult for the applicant to defend the proceedings in Pune. The respondent, though served, has not entered appearance. 4.
Thus, the proceedings bearing Petition-A No. 1472 of 2018 pending before the Civil Judge, Senior Division, Pune is directed to be transferred to the Civil Judge, Senior Division, Majalgaon. 5.
The Miscellaneous Civil Application stands accordingly disposed of.
