Heard learned Counsel for the applicant. The respondent, despite service, remained absent. The applicant is seeking transfer of Petition No. 843 of 2019, fled by the respondent-husband for getting divorce, from the Family Court No.3 Pune to the Family Court, Latur.

The applicant is not having independent source of income. She is at present maintaining two sons of tender ages. Further, one proceeding under Section 498A of the

{2} mca232.19.odt Indian Penal Code, lodged at her instance, is also pending at Ambejogai wherein the respondent-husband has already appeared. Moreover, the distance between Pune and Latur is more than 300 KMs.

There is no oppose to the application and, therefore, considering the convenience of applicant wife, following order is passed:

(A) Misc. Civil Application is hereby allowed.

(B) Petition No. 843 of 2019, is transferred from Family Court No.3, Pune to the Family Court, Latur, for disposal according to law.

{C} The respondent-husband is directed to appear before the Family Court, Latur, on or before 15th March, 2023. (SANDIPKUMAR C. MORE) JUDGE adb
