1) Learned counsel for the appellant is heard on the point of grant of leave to file appeal. Seen the judgment and order delivered in a case filed under section 138 of the Negotiable Instruments Act. Copies of evidence are also produced. Defence of the accused also is on the record which can seen in the statement given under section 313 of the Code of Criminal Procedure. Signature on the cheque is admitted but the Court has held that existing liability is not proved. There is arguable case for the original complainant. So leave is granted. Appeal is admitted. Notice after admission made returnable on 4th September 2015.
