PER COURT:

1] Heard mr. Thombre, learned counsel for the petitioner. Mr. Karad, learned counsel for the respondent Municipal Corporation on instructions submits that as far as the construction made by the petitioner on the writ land is concerned the same is without permission. The Corporation would follow the provisions of the BPMC Act in respect of the said constructions. As far as the land is concerned, the respondent Corporation would follow the procedure under the Land Acquisition Act or the MRTP Act, for acquiring the property.

2] Mr. Thombre submits that the construction is not unauthorised. 3] In view of the statement made by the learned counsel for the Corporation that due procedure of law would be followed, the writ petition is disposed of.
