The applicant apprehends his arrest in connection with Crime No.559 of 2022 registered with Pathardi Police Station, District - Ahmednagar for the offence punishable under section 302, 307, 326, 324, 323, 337, 212, 143, 147, 148, 149, 504, 506 read with 34 of the Indian Penal Code and u/s 7 of the Maharashtra Prevention of Defacement of Property Act. 2.

The FIR is lodged by Balasaheb Navnath Palve, against 16 accused persons. Name of the applicant appears at serial No.9. Active role is attributed to accused Suresh Mahadev Palve, Anil Eknath Palve, Sunil Eknath Palve, Ganesh Sunil Palve and other accused persons, who have assaulted the injured with deadly

{2} aba1430-22 weapons. So far as present applicant is concerned, general allegation is levelled that he and other accused persons at the time of incident pelted stones, gave abuses and threats. 3.

Heard learned advocate for the applicant and the learned Additional Public Prosecutor. Perused the papers of investigation. 4.

Charge sheet is filed in the present case on 14th September, 2022 and the case is numbered as RCC No. 469 of 2022.

Co-accused persons, who are attributed similar role as that of the applicant, are granted protection by this Court by orders dated 27th July, 2022, 22nd August, 2022 and 5th August, 2022. On the ground of parity, the applicant deserves similar protection.

Considering the role attributed to the applicant and the fact that similarly situated accused persons are granted anticipatory bail, the application deserves to be allowed and the same is hereby allowed, by confirming interim order dated 20th October, 2022. The applicant shall not tamper prosecution evidence.
