The present petitioner is challenging the order dated 12.11.2021 passed by the learned S.D.O., Rahata in Revision Application No. 302/2021, whereby the request for stay came to be refused.

Learned counsel for the petitioner submits that the purpose would be served if this Court directs the S.D.O. to decide the matter on its own merits.

In view of the above, the present petition stands disposed of. The concerned S.D.O. is directed to decide the appeal, 939 WP 5973.2023.odt

if not already decided, within a period of two months from today. 5.

Learned counsel for the petitioner states that the R.C.S. No. 335/1997 is pending on the same subject. In view of the fact that the application below Exhibit 5 came to be rejected and that the suit is of the year 1997, learned Trial Court is directed to decide the suit within a period of one year from today.
