APPLICANT

VERSUS

Sayyad Jamadar Mahammad ...

RESPONDENT .....

Shri C.V. Dharurkar, A.P.P. for applicant/ State Shri Vijay Sharma, Advocate for respondent .....

CORAM:

N.W. SAMBRE, J.

DATED:

24th October, 2016.

ORAL ORDER :

1.

Heard Mr. Dharurkar, learned A.P.P., who invites my attention to the issue of conversion of Writ Petition to that of revision. The order impugned in the present application is passed on December 1, 2015 by the Additional Sessions Judge, discharging the accused under Section 227, for an offence punishable under Sections 7, 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988. The said order was passed on December 1, 2015 and the Writ Petition was filed on or about April 12, 2016.

Cri.Appln.No.5525/2016 2.

Perused the contents of the application. The delay appears to have been caused on the administrative side. The learned counsel for the respondent - non applicant seeks time to file his reply. In my opinion, looking to the nature of case cited in the application for condonation of delay, the delay needs to be condoned. The application stands allowed. Delay condoned. (N.W.
