The learned counsel for the applicant submits that as per Section 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity B.N.S.S.), the Superintendent of Jail has written a letter to the learned Sessions Judge to consider the bail under the provisions of the B.N.S.S. 2.

In view of the same, the learned counsel seeks leave to withdraw the present application and move before the Sessions Court. 3.

In view of the above submissions, the Bail Application is dismissed as withdrawn with liberty to apply before the Sessions Court in terms of Section 479 of B.N.S.S.
