On the one hand, the petitioner contends that earlier, he had voluntarily resigned from employment, yet his resignation was not accepted. Subsequently, as is claimed by the Petitioner, a bogus resignation letter dated 29.11.2021 was prepared by unknown persons and was tendered to the Head Master and the same was accepted. The Head Master after acceptance of the resignation, restrained the Petitioner from entering the school premises. He further contends that he received a letter on 01.04.2022 from the office of the Chief Executive Officer, Zilla Parishad, Nanded approving his resignation.

The Petitioner further contends that he has made several representations to several authorities including the Hon'ble President of India, the Hon'

ble Prime Minister of India, the Hon'ble Chief Minister of Maharashtra and the Chief Secretary of the State of Maharashtra. Several authorities at the local level have also been served with such representations.

The Petitioner submits that, because of a fraud and a bogus act, a fictitious resignation letter was prepared and the same was accepted. He was physically and mentally tortured by the Block Education Officer and the Head Master. However, he has not lodged any F.I.R. against any of them. He has also not challenged his illegal removal from service on the basis of a false resignation in these last 21 years.

In view of the above, we do not find that this Court can issue a Writ of Mandamus, directing the authorities to embark upon a roving inquiry after 21 years.

This Petition is, therefore, dismissed.

At this stage, the learned Advocate for the Petitioner prays for liberty to challenge the forceful resignation. 7.
