Since the parties in both the civil suits are different, no fault can be found with the impugned order, by which, application under Section 10 of the Code of Civil Procedure, is rejected by the learned trial Court.

However, since the subject matter of both the suits appears to be same, the petitioner is at liberty to make appropriate application before the learned trial Court for consolidation of both the suits. 3.

If the suits are not pending before the same Court, appropriate application for transfer of one of the suits can be made and thereafter, application for consolidation can be filed. 4.

Writ Petition stands disposed of. Pending Civil Application is also disposed of.
