Learned counsel for the respondents strongly opposed the application contending that the reasons assigned for condonation of delay are incorrect. The applicant wants to protract the trial. Hence, delay may not be condoned.

3. Perused the application. The reasons assigned for the delay appears possible. The matter was not decided on merit. The Court is of the view that delay is liable to be condoned. Hence, the following order :
