1] Heard learned counsel for the applicants and the learned APP for the respondent-State.

2] The applicants are apprehending arrest in connection with Crime No.0296 of 2024, registered at Kopargaon Gramin Police Station, District Ahmednagar, for the offences punishable under Sections 119(1), 118(1), 115(2), 352, 189(2), 191(2), 191(3), 190, 351(2), 351(3), 324(4), 324 (5) of the Bharatiya Nyay Sanhita, 2023. 3] The learned counsel seeks leave to withdraw the application to the extent of Samadhan @ Golya Sanjay

Kolpe / applicant no.1.

The application is permitted to be withdrawn to the extent of applicant no.1. / Samadhan @ Golya Sanjay Kolpe.

4] Perused the FIR as regards the applicant no.2 / Nikhil Vijay Kolpe. From the FIR it appears that there is no specific role attributed to applicant no.2, except use of fist and legs. The medical report indicates that the injuries are minor in nature, as such, Nikhil Vijay Kolpe / applicant no.2 can be granted anticipatory bail.

5] In view of the above, the application is allowed to the extent of applicant no.2 / Nikhil Vijay Kolpe in the following terms :

i] In the event applicant no.2 - Nikhil Vijay Kolpe is arrested in connection with Crime No.0296 of 2024, registered at Kopargaon Gramin Police Station, District Ahmednagar, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

ii] Applicant no.2 - Nikhil Vijay Kolpe shall attend the police station as and when required by the Investigating Officer.

iii] Applicant no.2 - Nikhil Vijay Kolpe shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] Applicant no.2 - Nikhil Vijay Kolpe shall cooperate with the investigation and also in the proceedings before the trial Court.

6] In the event, applicant no.2 - Nikhil Vijay Kolpe violates any of the conditions specified in this order, it shall be liable to be cancelled.

7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
