Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0467/2024 dated 07/07/2024, registered at Dhule Taluka Police Station, District Dhule, for the offences punishable under sections 64 (1), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

The complainant has lodged a complaint against the applicant/accused, stating that on 29/06/2024, at 08:00 p.m., while she was alone at home, the accused/applicant entered her residence, committed the offence of rape, and threatened to kill her. This statement was reiterated before the Magistrate, and the minor delay in lodging the FIR was explained. She initially filed the FIR with the Ravet Police Station, and it was subsequently transferred to Dhule Taluka Police Station. Considering the FIR and the police statement, after preliminary Page 1 of

940 ABA 1668-2024 investigation, the police noted that the victim's clothes were removed from the room. Accordingly, additional sections for destruction of evidence were incorporated.

In view of the above, the case requires investigation through custodial interrogation, and thus, no case has been made out to grant anticipatory bail to the accused. The application is dismissed. ( ARUN R. PEDNEKER, J. ) vj gawade/-.
