PER COURT :- The petitioners claim to belong to other backward class category (OBC) and have been admitted to Engineering course, as against seats earmarked for reserved category. Proposals tendered by the petitioners for validation of the caste certificates are stated to be pending with the scrutiny committee and no decision has been taken as yet. On account of failure of the petitioners to submit validation certificates, the concerned college has directed cancellation of the admission of the petitioners on 26.9.2018. The order canceling admission appears to have been issued

{2} WP 11090.18 & ORS.odt after completion of process of admission. There is no likelihood that the admission authority would send fresh candidates in place of the candidates whose admission has been cancelled, since the process of admission has already come to an end now.

Under these circumstances, we direct the respondent Scrutiny Committee to take decision on the caste certificate verification proposals pending with it as expeditiously as possible and preferably within a period of one month from today and it is accordingly directed. It is informed that the petitioners in Writ petition No.11090 and 11096 of 2018 have not furnished original documents and have relied upon the photo-stat copies. They shall comply with the objections raised by the committee within one week from today.

The petitioners shall cause appearance before the scrutiny committee on 9.10.2018 and as such, no separate notice requiring their presence before the committee shall be necessary. The order passed by the College dated 26.9.2018 stands quashed and set aside. The admission granted to the petitioners shall be subject to outcome of the decision of caste verification proposal pending with the scrutiny committee and appropriate orders may be passed by the concerned college, depending upon outcome of the certificate verification proceedings.
