Learned counsel for the applicant states that, all the three respondents are served with the copy of Civil Application. Learned A.G.P. for respondent No.1 and learned counsel for respondent No.2 waive service.

Heard learned counsel for the parties. We have perused the averments made in the Civil Application. The applicant has made out a case for restoration of the Writ Petition

C.A. No.13083/2016 No.3260/2010, which came to be dismissed for want of prosecution by order dated 10/11/2014. We, therefore, pass the following order :

O R D E R

(i) Civil Application is made absolute in terms of prayer clauses (B) and (C).

(ii) Writ Petition No.3260/2010 be placed for admission on 3rd October 2017.

(iii) If any affidavit-in-reply has to be filed by any of the respondents, the same shall be filed in advance and the copy thereof shall be served on petitioner's Advocate well in advance.
