{2} ca970111.odt

Versus

The State of Maharashtra & others Respondents Mr.G.V.Wani, advocate for the appellant.

Mr.S.G.Nandedkar, A.G.P. for Respondents No.1, 2 and 4. CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 02nd July, 2015 PER COURT:

The appellant is objecting to the order dated 02.02.2010, passed by the learned Single Judge of this Court in Writ Petition No.7736 of 2009, whereby the learned Single Judge was pleased to grant 'Rule' in the petition and refused to grant interim stay. Since more than five years have passed since the date of refusal of interim relief by the learned Single Judge, no interference is called for at this belated stage. It would be open for the appellant to move the learned Single Judge for disposal of pending writ petition expeditiously.

Letters Patent Appeal stands dismissed. Pending Civil Applications do not survive and stand disposed of. P.R.BORA R.M.BORDE JUDGE JUDGE
