The writ petition can be disposed of in view of the consensus of both the counsel for the parties that the issue of jurisdiction can be framed. The dispute arose as after a period of 14 years, an application was moved for framing the issue of jurisdiction as a preliminary issue.

In view of the fact that the parties agree that the issue of jurisdiction can be tried as one of the issues in the suit, the writ petition stands disposed of.
