CORAM : S. V. GANGAPURWALA AND SANGITRAO S. PATIL, JJ.
DATE : 17TH MARCH, 2017.
PER COURT :
.
In all these writ petitions, except Writ Petition No. 10233 of 2016 validity certificates are issued to petitioners in respect of the tribe Mannervarlu.
2.
The learned counsel submits that, in the school record, there is clerical error in respect of Mannervarlu. In vernacular language the same is recorded as Munnarwarlu. The petitioners have applied for correction of the same. Those applications have been rejected on the ground that, the petitioners have left the school.
2.
Mrs. Kshirsagar, the learned counsel for the Education Officer submits that, as per Sec. 26.4 of the Secondary School Code correction cannot be made after the student has left the school.
3 wp 10231.16 3.
We have also heard the learned Assistant Government Pleader for respondent Nos. 1 and 2.
4.
Upon perusal of said certificates, school record and the validity certificates issued to petitioners, it appears that, the same is only a clerical error. It is not a case of change of entry of caste or date of birth. It is only correction of clerical error. Instead of Munnarwarlu, the same is required to be written as Mannervarlu.
5.
Considering the above, the impugned order is set aside. The Education Officer shall entertain and reconsider the applications of the petitioners and pass necessary orders with regard to correction of the caste in the school record of the petitioners as 'Mannervarlu'. The same be done expeditiously. The writ petitions accordingly are disposed of. No costs. [SANGITRAO S. PATIL, J.] [S. V. GANGAPURWALA, J.] bsb/March 17
