BENCH AT AURANGABAD CIVIL APPLICATION NO.14800 OF 2015 IN WRIT PETITION NO.8791 OF 2015 HASINABEE D/O SAHEBKHA PATHAN APPLICANT
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS RESPONDENTS Mr.A.A.Shelke, Advocate for the applicant.
Mr.P.G.Borade, AGP for respondent Nos. 1 to 3. Mr.S.S.Naik, Advocate for respondent No.4.
( CORAM : RAVINDRA V. GHUGE, J.) DATE : 04/12/2015 PER COURT :
1.
Mr.A.A.Shelke, learned Advocate for the applicant submits that he intended to canvass before this Court on 05/10/2015 that bogus documents were annexed by respondent No.4 to her application seeking appointment as "Anganwadi Sevika" and the concerned authorities have still appointed her. He submits that erroneously instead of saying bogus documents, it was canvassed as "no documents" as is recorded in paragraph Nos.2 and 3. 2.
By this civil application, he seeks substitution of the words "no documents" by the words "bogus documents" in paragraph nos. 2 and 3 of the order dated 05/10/2015.
3.
Mr.Shelke confirms the above statements and submits that khs/Dec.2015/14800-d
though it is not so specifically prayed in the application, the words "bogus documents" can be stated in paragraph nos. 2 and 3 of the order and rest of the order can be maintained. 4.
Mr.Naik, learned Advocate for the original respondent No.4 in the petition opposes this application strenuously. He further submits that an affidavit in reply would be entered in the writ petition to point out that all the documents annexed by respondent No.4 were genuine and authentic.
5.
Considering the above, this civil application is allowed. Order dated 05/10/2015 shall stand corrected to the extent of replacing the words "no documents" by the words "bogus documents" in paragraph Nos. 2 and 3. Corrected order be placed on record. ( RAVINDRA V. GHUGE, J.) khs/Dec.2015/14800-d
