Learned Counsel for the petitioners submits that the petitioners in these petitions are appointed from reserved category.

The proposal seeking approval to their appointment are forwarded by the management to the Education Officer / Deputy Director of Education but the Education Officer / Deputy Director of Education is not taking any decision upon it.

On the ground that the Education Officer / Deputy Director of Education has not yet granted approval to the appointment of the petitioners, the management has issued notices to the petitioners seeking termination of their services. This Court has protected services of the petitioners.

Mr. Bolkar, learned Counsel appearing for the respondent - management, accepts that the petitioners are appointed from reserved category and their proposals are forwarded by the management to the Education Officer / Deputy Director of Education for approval.

Learned Assistant Government Pleader appearing for the respondent - State submits that the proposals are pending with the Education Officer /

(Order) (33) W.P. No. 06018 of 2016 Deputy Director of Education and the Education Officer / Deputy Director of Education would decide it on its own merits.

According to the learned Counsel for the petitioners, the ban on recruitment as was laid down under the Government Resolution dated 02nd May 2012, would not apply in view of the Government Resolution dated 13th April 2011 and the judgment of this Court in Writ Petition No. 10580 of 2015 (Sou. Revati Kusha Wagh & another Vs. The State of Maharashtra & another) and companion petitions, decided on 09th March 2017.

The Education Officer / Deputy Director of Education certainly would consider the aforesaid judgment delivered by this Court. Parties are at liberty to bring it to the notice of the Education Officer / Deputy Director of Education, relevant Government Resolutions and the judgment of this Court while deciding the proposals for their approval. 06.

In the light of the above, impugned notices issued by the management seeking termination of services of the petitioners are quashed and set aside. The Education Officer / Deputy Director of Education shall decide the proposals seeking approval to the appointment of the petitioners, on its own merits, in accordance with law, as per relevant Government Resolutions and judgments of this Court, as expeditiously as possible and preferably within a

(Order) (34) W.P. No. 06018 of 2016 period of three months from the date of this order. 07.

It is further directed that the employer shall not take any further steps against the petitioners only on the ground that the proposals seeking approval to their appointment are pending. 08.

The Writ Petitions are accordingly disposed of. No costs. Pending Civil Applications stand disposed of.
