Heard. For the reasons stated in criminal application No. 3200 of 2021, the same is allowed in terms of prayer clause "A" and disposed of.

In so far as bail application No. 1439 of 2021 is concerned, by order dated 17.10.2019 this Court has rejected the bail application No. 1219 of 2019 filed by the present applicant for regular bail. This is successive bail application filed on the ground of change in circumstance that co-accused came to be released on bail by the Apex Court.

Learned A.P.P. on instructions in writing submits that the prosecution has examined the investigating officer in the month of February, 2022 and is likely to close the evidence by filing pursis. In

ba1439.21 -2view of the same, it is not appropriate on the part of this Court to make certain observations on merits. Though learned counsel for the applicant has submitted that the accused persons in connection with the case may examine number of defence witnesses and the said aspect may delay the trial, however, for the said reason also I am not inclined to consider this application on merits. The trial court has seized with the matter. Hence, the following order:-

Bail application is hereby rejected.
