The learned Assistant Government Pleader submits that if the petitioner is seeking disqualification against a particular person on the ground of encroachment, then the petitioner has a remedy under the provisions of the Maharashtra Village Panchayat Act to approach the Collector.

In light of the above, we need not consider the matter on merits.

The petitioner may approach the Collector as may permissible in law and take up appropriate proceedings.
