PER COURT :
.
The petitioner seeks directions against the respondent Nos. 1 to 3 to make an enquiry U/Sec. 65 of the Bombay Tenancy and Agricultural Lands Act, 1948. So also seeks directions to consider the application/representation of the petitioner dated 24.09.2008.
2.
We have heard Mr. Patil, the learned counsel for the petitioner and the learned Assistant Government Pleader for respondents/State. In normal course we give directions to the authorities to decide the application/representation. However, considering the nature of the directions sought in the present matter, we refrain from exercising our jurisdiction. The
2 wp 5177.13 petitioner is not concerned with the land of the present respondents. The prayer is that the Government shall repossess the lands of these respondents on the ground that, it is not cultivated for number of years.
3.
In case the petitioner would have had any concern with writ land or would have had any interest in that land or if any public cause would have been involved, then we could have considered request of the petitioner. As the petitioner is not even remotely concerned with the said land, we are not entertaining this writ petition.
4.
The writ petition as such is disposed of. No costs. [ K. K. SONAWANE, J. ] [ S. V. GANGAPURWALA, J. ] bsb/June 16
