IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 349 WRIT PETITION NO.11120 OF 2022 NIRMALA NANASAHEB PAWAR

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS .....

Advocate for Petitioner : Mr. Kedar Shrimant R AGP for Respondents 1 to 3: Mr. S.K. Tambe .....

CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.

DATED : 16th NOVEMBER, 2022.

PER COURT :- 1.

The petitioner seeks issuance of a writ of mandamus to a private Education Society to pay unpaid salaries from June, 2010 to June, 2011, as an untrained teacher and from June, 2012 till date, as a trained teacher. She claims to be working as a Junior Lecturer. She now prays for 12% interest on account of delayed payment. 2.

On perusing the petition papers, though there are representations placed before us, all of them have been addressed to the private management. Amongst the documents placed on record, there is not a single application or a complaint addressed, either to the Education Officer or the Deputy Director of Education. 3.

In these circumstances and considering the passage of 12 years, coupled with the fact that not a single letter is addressed to the

wp11120.22 -2statutory authority, this petition is disposed off with liberty to the petitioner to approach the Deputy Director of Education, respondent No.2, with specific details of the employment and unpaid salaries alongwith the copy of the approval order to the appointment of the petitioner. Upon receipt of such representation, accompanied by the documents, respondent No.2 would initiate appropriate steps and call upon the management to respond.

4.

Let this exercise be completed expeditiously and preferably within a period of three months from today.
