BENCH AT AURANGABAD 2 - CONTEMPT PETITION NO. 680 OF 2016 & ORS Complaints under Section 48(1) read with Section 39 and 55 of the the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 ("the said Act ") which are still pending before the Labour Court. The directions of this Court in paragraph 11(e), (f) and (g) take care of the interest of the petitioners. Since the Labour Court has decided the proceedings under Section 33C(2), the amounts had to be deposited in the Criminal proceedings before the Labour Court within two weeks from 18.3.2016. If the said amounts are not deposited, these petitioners would be at liberty to proceed with the Criminal (ULP) complaints.
5.
Since the above said remedy is available to the petitioners, all these Contempt Petitions are, therefore, disposed off. ( RAVINDRA V. GHUGE, J. ) ...
