Heard learned Counsel for the petitioner and learned A.G.P. appearing for respondent State.

It appears that the petitioner has filed detailed representation to the Minister for Social Justice and Special Assistance Department, Government of Maharashtra, Mantralaya, Mumbai. It also appears that the said representation is titled, "DURUST APPEAL PRAT'. Learned Counsel for the petitioner fairly states that, the remedy of the appeal is not available and, therefore, he submits that the said "DURUST APPEAL PRAT' may be considered as representation by respondent no.1 and the concerned Minister, and directions may be given to them to decide the said representation on merits, as expeditiously as possible. The Counsel appearing for the petitioner invited our attention to the order passed by this Court in the case of (1) WP - agp/-

The State of Maharashtra and others ) and (2) Writ Petition No.4666/1997, dated 8th July, 2010, in the case of Nav Yuvak Shikshan Sanstha, Hanegaon Vs. Jai Javan Jai Kisan Samajik Shaikshanik Sanstha, Kini, and submits that, in similar set of facts, this Court has directed the State Government to consider the prayers of the petitioners therein, regarding admissibility of grants to the petitioner institutions therein. 3.

In the light of discussion in foregoing paragraph, we direct respondent no.1 to take a decision, if already not taken, on afore mentioned representation, about admissibility of grants to the petitioner institution, as expeditiously as possible, and preferably within a period of three months from today on its own merits, in accordance with law and Government policy. We make it clear that respondent no.1, or the concerned Minister, as the case may be, will be at liberty to hear the petitioner, if they feel it necessary.

The decision so taken by the concerned authority shall be communicated to the petitioner forthwith.
