There is no dispute about the fact that charge-sheet has been filed in this case. The co-accused who were arrested are enlarged on bail.

Learned counsel for the applicants submits that the condition imposed of the attendance of applicants be cancelled. 4.

In view of the filing of the charge-sheet, the applicants are not required to attend the concerned Police Station. 5.

Having regard to the above facts, application stands allowed in terms of interim order dated 07/10/2024 except for the condition of aba1673.24.odt

attendance.

Learned counsel for the informant makes grievance that the present applicants failed to appear before the Trial Court in the proceedings filed under Section 498-A of IPC by the deceased. He, therefore, apprehends that the applicants could not attend the proceedings.

Learned counsel for the applicants, on instructions, makes statement that the applicants would appear before the Trial Court on every date of proceedings except exemption is granted. The statement is accepted as undertaking. In case applicants remain absent before Trial Court without seeking exemption from presence, it would be open for trial Court to take them in custody for reason of breach of undertaking given to this Court.
