ORDER:- 1.

Heard the learned counsel for the applicant - wife. The respondent husband though served, but remained absent. 2.

The applicant - wife is seeking transfer of HMP No. 426 of 2022 filed by the respondent -husband for restitution of conjugal rights, from the Court of learned Civil Judge (Senior Division), Baramati to learned Civil Judge (Senior Division), Shrigonda, District Ahmednagar. It appears that the applicant is not having any independent source of income. Moreover, she is having minor son aged about 4 years to look after. She has also filed proceeding under Domestic Violence Act against the respondent at Shrigonda.

As such, considering the convenience of the applicant wife, following order is passed.

ORDER

(i) The application is allowed.

(ii) HMP No. 426 of 2022 is hereby transferred from the Court of Civil Judge (Senior Division), Baramati to the Court of Civil Judge (Senior Division), Shrigonda, District Ahmednagar for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Shrigonda on or before 25th January 2023.

(iv) The application is accordingly disposed of.
