Present application is for condonation of delay, setting aside abatement and bringing legal heirs of sole respondent Dinkar Ramdas Sarode on record.

The learned counsel for the respondent opposes the application and submits that there are lapses on the part of the applicant, which cannot be ignored.

The averments in the application regarding condontion of delay are not controverted. The cause of action survives against the legal heirs of respondent Dinkar.
