Heard learned counsel appearing for the petitioners.

The application filed by the present writ petitioners i.e. original accused in the sessions court with a prayer that the accused be sent for Narco test, was dismissed. Inter alia, the learned Sessions Judge found that the application is not maintainable and the trial was at the concluding stage. It was also observed that the result of the Narco test is already held as inconclusive by the Supreme Court of India.

The order of the learned Sessions Judge cannot be faulted with. The learned Sessions Judge has properly
criwp1328-2015 found that the Narco test is taken as an aid for investigation. There is no merit in the writ petition. The writ petition is, therefore, dismissed.
