The application is filed for condonation of delay of 90 days caused in filing proceeding to challenge the judgment and order of Criminal Appeal Nos.78/2009 and 79/2009 delivered by the Sessions Judge Osmanabad. It is contended that time was required for processing the matter and getting approval to file the proceeding. In view of the contention this Court holds that sufficient cause is shown. Nobody has turned up for the respondent

to argue the matter though duly served. So, the application is allowed. Delay is condoned.

For considering the prayer to grant leave to file appeal, record and proceeding is necessary. Call record and proceeding from the court of the Judicial Magistrate First Class returnable on 17/08/2015. Stand over to 17/08/2015.
