Though appearance is caused by the Advocate on behalf of Respondent, neither say is filed nor anyone is appearing in this proceeding since last two dates of hearing. This indicates that Respondent has no inclination to oppose the application.

Applicant is wife. She claims to be resident of Latur. It is her contention that she is dependent on her mother and brother. She claims that it would be inconvenient for her to travel from Latur to Aurangabad to attend Marriage Petition No. A-196/2023 filed by Respondent before Family Court, Aurangabad.

Learned Counsel for the Applicant submits that considering the distance between Aurangabad and Latur,

922-MCA-274-2023.odt if Applicant is compelled to cause her appearance before Court at Aurangabad, she will not be in a position to defend herself effectively.

This submission is not contradicted by the other side.

In absence of any response to the application, contention of the Applicant deserves to be accepted. Hence, application stands allowed in terms of prayer clause 'B'.
