It is not in dispute that civil application No. 12688 of 2016 of the similarly placed applicant is allowed by this Court vide order dated 3rd October, 2016 and the respondents are directed to forward pension papers of the said applicant to the Accountant General, Nagpur for the purpose of commending provisional pension, subject to the applicable pension rules. 3.

The applicant was declared surplus and there is no stigma attached to his termination and except becoming surplus there is

In that view of the matter, the civil application is allowed in terms of prayer clause "B".
