This Civil Application is filed for withdrawal of remaining amount deposited by the Acquiring Body.

Admittedly, 12.5% amount out of 25% amount deposited by the Acquiring Body was permitted to be withdrawn by the Applicants.

In the order dated 4th March, 2022, passed in SLP No. 19543 of 2021, filed by the Applicants, the Apex Court has observed as follows:

{2} ca10566-25.doc "After we have heard the learned counsel for the parties, we clarify that let the balance sum of fifty percent of the twenty five percent enhanced compensation be released on furnishing of a bank guarantee of a nationalized bank and that shall remain alive until disposal of the appeal pending before the High Court. With this clarification the Special Leave Petition stands disposed of."

In view of the above directions, the Application is allowed. The Applicants are permitted to withdraw the balance amount of compensation deposited by the Acquiring Body, along with the interest accrued thereon, on furnishing bank guarantee of a nationalized bank, which shall remain alive until disposal of the appeal. The Applicants are permitted to furnish bank guarantee initially for two years and it should be renewed from time to time till disposal of the Appeal.
