Learned Additional Public Prosecutor opposes the request for relaxation of condition No.(iii) incorporated in order dated 16th June 2015 passed by this Court on the ground that the report of ballistic expert is awaited and as the investigation is complete, charge-sheet is likely to be filed.

In view of above, in my opinion, further presence of the applicant is not required, as observed in condition No.(iii) referred above. As such, the said condition is relaxed, however, the applicant shall respond to the written call given in writing by the Investigating Officer in case contingency arises.
