IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 78 CIVIL APPLICATION NO.2195 OF 2020 IN FAST/30656/2018 BABU SHRIMANT BODAKE (DIED) THR LRS CHAMAKBAI AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Applicants : Ms. S. A. Kale h/f. Mr. Ajeet B. Kale AGP for Respondents / State : Mr. A. B. Chate ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 19/12/2022.

PER COURT :

Heard rival submissions. The applicants -claimants are seeking condonation of delay of 2762 days which appears to be caused due to their financial crisis. The learned AGP strongly opposed the application on the ground that there is also circulation delay. The respondent No.3 -Acquiring Body though served, but remained absent.

2.

However, considering the statutory right of the applicants, the delay of 2762 days stands condoned subject to condition that the applicants shall not claim any interest for the aforesaid period of delay and also for the delay in circulating the matter belatedly.

3.

The appeal be placed for admission after removal of office objections, if any.

4.

The application is disposed of.
