The petitioner's claim of belonging to "Koli Malhar", Scheduled Tribe category is pending validation with the Scrutiny Committee since February, 2022. He joined employment as "Krushi Sevak" in 2020. He has received a notice dated 22.09.2022 calling upon him to submit a validity certificate. He apprehends termination.

The learned AGP submits on behalf of the Scrutiny Committee that the claim of the petitioner is pending vigilance cell enquiry and can be decided by 30.06.2023. 3.

In view of the above, this Writ Petition is disposed

The petitioner shall tender an affidavit undertaking to respondent No.5 and a copy to be filed in this Court, on or before 21.12.2022, declaring that the petitioner would not claim increments or promotions or further service benefits until his claim is decided.

On the condition of such filing of an affidavit undertaking, the petitioner shall not be terminated from service till 30.06.2023 or till the date on which the Scrutiny Committee delivers it's orders, whichever is earlier.
