IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.13517 OF 2017 Parwati w/o Sandipan Dhas Petitioner

Versus

The State of Maharashtra & others Respondents Mr.Ashok S. Pavse, advocate for the petitioner. Mr.A.R.Kale, A.G.P. for Respondent.

CORAM : R.M.BORDE & SMT. VIBHA KANKANWADI, JJ.

DATE : 21st November, 2017 PER COURT:

The petitioner has availed benefits under the Agriculturists' Insurance Scheme, however, she claims assistance under the Government Policy enumerated in Government Resolutions dated 30.01.2014 and 13.05.2015 in respect of granting aid out of the State Disaster Response Fund.

Admittedly, husband of the petitioner died as a result of occurrence of fire to the animal fodder. The alleged incident, which resulted in the death of husband of the petitioner, cannot be said to be a natural disaster or natural calamity. The claim of the petitioner does not come within the framework of the scheme and as such, her claim has been rightly rejected by the authorities. Since the petitioner has already received benefits under the Agriculturists' Insurance Scheme floated by the State Government, the respondent-authorities were justified in refusing to consider claim of the petitioner under the policy of the Government declared

{2} wp1351717.odt under the Resolutions dated 30.01.2014 and 13.05.2015 or subsequent Resolution dated 26th November, 2015. The petition is devoid of substance.

Writ Petition stands dismissed.
