On 25.07.2018, this Court had recorded the contentions of these litigating sides in it's order, which reads as under :- "1 This matter was taken on the Production Board in view of the request motion at 10:30 am that the Petitioner desires to withdraw this petition. The learned Advocate for Respondent No.1/ wife submits that pursuant to the divorce granted by the Trial Court by the judgment dated 09.07.2018 in Hindu Marriage Petition No.70/2013 on the consent of the Respondent/ wife, though this writ petition can be disposed of as withdrawn, the money which was directed to be paid to the Respondent/wife under the orders of this Court dated 07.11.2017, should be granted to the wife.

As the learned Advocates desire to address this Court on the issue of who should take the maintenance amounts deposited in this Court, stand over to 30.07.2018 under the caption of "passing orders"."

*2* The learned Advocate for the Petitioner, father of the male child Master Manav, who is 12 years of age today, submits on instructions taken from the Petitioner/ Father present in the Court, that the entire amount of Rs.68,000/- alongwith accrued interest, lying in this Court can be transferred to the Saving Bank Account of the Respondent/ Mother through this Court only for investing the said amount in the Fixed Deposit Receipt (FDR) in the name of Master Manav Anil Jorvekar, mother's name Swati Anil Jorvekar, for such period till three months after the 18th birthday of Manav. The original FDR can be retained by the Mother. A photocopy of the FDR would be filed in this Court as well as would be tendered to the Father within four weeks from today.

The said amount shall be utilized for the education of Manav after he turns 18 years of age. The learned Advocate for the Respondent/ Mother submits, on instructions, that this proposal is accepted. In view of the above and in the light of the statements made by the parties, this Writ Petition is disposed of with the following directions :- (a) The Registry of this Court shall transfer the amount of Rs.68,000/- (Rupees Sixty Eight Thousand) along with accrued interest to the Saving Bank Account of Smt.

IFSC Code :- PMCB0000004 (b) The Respondent/ Mother will forthwith invest the entire amount of Rs.68,000/- along with accrued interest in FDR in the name of Master Manav, under her guardianship, for a period till 17.01.2025 (birth date of Manav is 17.10.2006). (c) After 17.01.2025, the said amount can be utilized for the educational expenses of Manav with the consent of the Petitioner/ Father. For the above purposes, the Respondent/ Mother will inform the Petitioner/ Father as regards the object for the said expenditure and if it is for educational purpose, the Petitioner shall consent to the same. kps (RAVINDRA V.
