The learned Advocate for the Petitioner submits, on instructions, that the Petitioner desires to withdraw this petition with liberty to take recourse to Order 26 Rule 10(3) of the Code of Civil Procedure for establishing before the Trial Court that the report of the Court Commissioner is unreliable and the same does not deserve to be considered.

In the light of the above, this Writ Petition is disposed of as withdrawn with liberty as prayed for.
