IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD WRIT PETITION NO. 11007 OF 2016 Shahnawaz Khan Sardar Khan .. PETITIONER

VERSUS

The State of Maharashtra & others .. RESPONDENTS Mr. M.R. Andhale, advocate for petitioner.

Mr. S.B. Pulkundwar, AGP for the State.

===== CORAM : R.M. BORDE & SANGITRAO S. PATIL, JJ.

DATE : 17th NOVEMBER, 2016.

PER COURT :

Petitioner is objecting to the order passed by the Regional Transport Officer, Aurangabad rejecting application tendered by him seeking renewal of the authorisation to operate mobile PUC center. It is noticed that the authorisation earlier issued in favour of petitioner was for a duration ending on 09.11.2015. Petitioner, however, issued fitness certificate in respect of seven vehicles after the aforesaid date i.e. on 04.04.2016. Petitioner has indulged in illegalities in issuing fitness certificates in respect of motor vehicles after expiration of the period of authorisation permitted in his favour. This aspect has been noticed by the transport authorities and the application has been turned down. We do not find any illegality or irregularity in the action of respondents necessitating causing interference in the petition in exercise of extra ordinary jurisdiction under Article 226 of the Constitution of India. Writ petition is devoid of substance hence stands rejected.
