Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.249 of 2024 registered with Pundliknagar Police Station, District Aurangabad for the offences punishable under Sections 331(4), 305(a), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

A big theft was committed in the house of the complainant. The applicant was a servant of his landlord. It has been alleged against the applicant that he gave tips to the main accused, who was the habitual offender. However, during the course of investigation, not a single stolen article has been recovered from him. There was no sufficient evidence against the applicant to believe that he received the benefits from the stolen property. Some of the stolen

959-ba-1849-2024.odt (2) articles have been recovered at the instance of the co-accused. The investigation has been completed. There were no crimes registered against the applicant earlier to this crime. He is languishing in jail for reasonable time. Hence, it would be unjustifiable to keep him behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Vinod Uttamrao Patare, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that ; (a) The applicant should not tamper with the prosecution witnesses and should attend the trial on each and every date.
