Heard rival submissions.

The applicant, who is the wife of original accused Ramesh Kisan Shekade, is seeking leave to continue the appeal by herself by taking her on record.

Learned A.P.P. though opposed the application, but as per Section 394 of the Code of Criminal Procedure, the near relative of the deceased accused can apply for such leave to continue the appeal. The deceased accused was public servant and on his conviction the pensionary benefits to the family members are yet to be released. Considering such aspect, the application stands allowed in terms of prayer clause (B) and leave is granted to the applicant to continue the appeal. The necessary amendment be carried out forthwith. 4.

Application is accordingly disposed of.
