Heard both sides.

2] Learned counsel for the applicant files on record a photocopy of the receipt issued by the concerned court regarding deposit of an amount of Rs.Five Lakhs by the applicant. The same is accepted on record and marked as "X" for the purpose of identification.

2 3-crappln5633-15.odt 3] Vide order dated 16th January, 2013, on the basis of the statement made by learned counsel for the applicant, that the applicant shall deposit an amount of Rs.Five Lakhs in the trial court, subject to the decision in the trial court, temporary bail was granted to the present applicant by this Court. The applicant, however, could not deposit the amount as undertook and shown difficulties in arranging for the amount. 4] Learned counsel for the applicant submits that since the amount is now deposited, the applicant may be granted anticipatory bail.

5] Learned A.P.P. opposes the application. He submits that the parents of the complainant has committed suicide as present applicant has deceived Nitin, brother of the complainant, for an amount of Rs.Fifteen Lakhs.

3 3-crappln5633-15.odt 6] Considering the overall material on record and as the applicant has deposited the amount, as directed earlier, present application is hereby allowed. In the event of arrest of the applicant in Crime No.166 of 2012 registered with Sakri Police Station, Dist. Dhule for the offences punishable under Section 306, 420, 506 read with 34 of Indian Penal Code and Sections 32(B) and 33 of the Money Lending Act, he be released on bail upon his executing P.R. bond in the sum of Rs.1,00,000/- (Rs.One Lakh) and also upon furnishing surety in the like amount.
