Applicants apprehend arrest in connection with with C.R. No. 270/2024 registered with Majalgaon City Police Station, Dist. Beed for the offences punishable under Sections 409 and 420 of the Indian Penal Code and
Sections 3 and 4 of The Maharashtra Protection Of Interest Of Depositors (In Financial Establishments) Act, 1999.

First information report indicates that the Informant had deposited certain amounts with Hindavi Swarajya Urban Co-operative Credit Society Ltd, Majalgaon. There is allegation against accused Suresh More that he instigated the informant and others to deposit money into the said society. Though it is said that certain amounts were returned to him after insistence, however, a sum of Rs. 17,50,000/- is still payable to the informant and others.

Learned Counsels for the Applicants submit that though Applicants are the directors of the said society, there is no allegation against them in the FIR. They drew attention of the Court to the subsequent crime registered in respect of same society being Crime No. 499/2024 wherein the Applicants are granted anticipatory bail by the learned Special Judge (MPID). It is contended that nothing is to be recovered at their instance. Learned Counsels for the Applicants, on instructions, makes statement that the Applicants never
participated in the affairs of the society.

Learned APP opposed the applications by citing seriousness of the crime. It is his submission that there are documents indicating that the Applicants did sign panchnamas.

When the Applicants have come out with a case that though they were shown as directors of the Society and having participated in the society, prima facie there has to be some evidence to indicate their involvement into the affairs of the society, which is absent in this case. Apart from this, number of Applicants are already enlarged on anticipatory bail in connection with subsequently registered crime i.e., Crime No. 499/2024 registered with Majalgaon City Police Station.

Having regard to these facts, this Court finds no impediment in allowing the applications. Hence, applications stand allowed by confirming interim orders.
